By accessing or using BetaStudy (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

BetaStudy is an online certification exam preparation platform that provides practice questions, study materials, and exam simulations for various IT certifications. The Service is provided on an “as is” and “as available” basis.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access
  • Not share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly, quarterly, or annually). You authorize us to charge your payment method for all fees.

Free Trial

The free tier includes limited access to practice questions. No credit card is required for the free tier.

Cancellation

You may cancel your subscription at any time through your account settings or the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Refunds

We offer a 30-day money-back guarantee for new Pro subscribers. To request a refund, contact support@betastudy.app within 30 days of your initial purchase.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share, distribute, or reproduce practice questions outside the platform
  • Attempt to reverse engineer, decompile, or extract our content or algorithms
  • Use automated tools to scrape or access the Service
  • Interfere with or disrupt the Service or servers
  • Impersonate others or provide false information
  • Upload malicious code or harmful content
  • Violate any applicable laws or regulations

6. Intellectual Property

The Service and its original content, features, and functionality are owned by BetaStudy and are protected by international copyright, trademark, and other intellectual property laws.

Practice questions, explanations, and study materials are provided for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Third-Party Trademarks

Certification names, logos, and trademarks (such as AWS, Microsoft, Google Cloud, etc.) are the property of their respective owners. BetaStudy is an independent exam preparation platform and is not affiliated with, endorsed by, or sponsored by any certification provider. Our practice questions are designed to help you prepare for exams but are not official exam materials.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation
  • That using our Service will result in passing any exam

While we strive for accuracy, we cannot guarantee that our practice questions exactly match actual exam content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETASTUDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

10. Indemnification

You agree to indemnify and hold harmless BetaStudy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Service or sending an email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BetaStudy operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
