1. About BetaStudy

BetaStudy is an educational technology platform designed to assist users with professional and technical certification preparation.

BetaStudy may provide:

• Practice questions
• Explanations
• Simulated examinations
• Study plans
• Personalised recommendations
• Performance statistics
• Flashcards
• Learning analytics
• XP (Experience Points)
• Streaks
• Badges
• Leaderboards
• Study activities
• Certification information
• Community features
• Other educational tools

BetaStudy is a tool intended to assist your learning and examination preparation.

2. Eligibility

You may use BetaStudy only if:

• You are at least 16 years old, subject to the applicable certification's age requirements;
• The information you provide is accurate and current;
• You have the legal capacity required to enter into these Terms;
• You comply with these Terms and applicable law; and
• You maintain the security of your account.

If a certification provider imposes a higher age or eligibility requirement, that requirement applies to the relevant certification.

3. Global Service

BetaStudy is owned and operated by SPLEXX INNOVATION DYNAMICS LTD, a Nigerian-registered company, but BetaStudy is intended as a global product.

Nigerian law governs these Terms as described below, but nothing in these Terms is intended to remove or restrict mandatory consumer, privacy or other rights that apply to users under the laws of their country of residence.

4. Creating an Account

You may create a BetaStudy account using:

• Email and password;
• Google; or
• LinkedIn.

You are responsible for ensuring that the information associated with your account is accurate and current. Each account is intended for one individual user.

5. Account Security

BetaStudy provides security measures including:

• Email verification;
• Password reset;
• Two-factor authentication (2FA);
• Login/session monitoring; and
• Account lockout or rate limiting following repeated failed login attempts.

You are responsible for protecting your login credentials. You must notify BetaStudy promptly at hello@betastudy.com if you suspect unauthorised access, credential compromise, account theft, or other security problems.

6. Free and Paid Plans

BetaStudy may offer:

• A permanent Free plan;
• Monthly Pro subscriptions;
• Three-month Pro subscriptions;
• Annual Pro subscriptions; and
• Other plans introduced from time to time.

BetaStudy may change its available plans, features and pricing in accordance with these Terms.

7. Pricing and Currency

Prices may be displayed in different currencies depending on your location, billing settings, payment provider, or other applicable factors. The applicable price is the price clearly displayed to you at checkout.

Prices shown at checkout may include or exclude applicable VAT, GST, sales taxes, or other legally applicable charges. Any applicable taxes or additional charges will be disclosed before you complete payment, where required.

8. Promotional Pricing

BetaStudy may offer temporary discounts, introductory prices, promotional pricing, referral discounts, special offers, credits, and other promotional benefits. Each promotion may have its own eligibility requirements, duration and conditions.

Unless expressly stated otherwise, promotions do not automatically create an entitlement to future discounts.

9. Payment Processing

Payments are processed by Stripe. BetaStudy does not store complete payment-card information.

You authorise Stripe and applicable payment providers to process payments associated with your subscription. You agree to provide accurate billing information and to maintain a valid payment method where required for an active subscription.

10. Automatic Renewal

Paid subscriptions automatically renew at the end of the applicable billing period unless cancelled before renewal. The applicable renewal price and billing period will be disclosed at purchase and/or through the applicable subscription interface.

You are responsible for cancelling your subscription before the next renewal if you do not wish it to renew.

11. Cancellation

You may cancel your subscription:

• Through your BetaStudy account/dashboard; or
• By contacting hello@betastudy.com.

Cancellation generally becomes effective at the end of the current paid billing period. You will retain access to applicable Pro features until the end of the paid period, unless your access is suspended or terminated in accordance with these Terms or applicable law.

Cancellation does not automatically entitle you to a refund for the unused portion of the current billing period except where provided under our refund policy or required by law.

13. Free Plan & Pro Trials

BetaStudy currently provides a permanent Free plan and does not currently provide a separate Pro free trial. BetaStudy may introduce free trials in the future and may establish separate trial terms.

14. Changes to Pricing

BetaStudy may change subscription prices. Where a price change affects an existing recurring subscription, BetaStudy will provide reasonable advance notice where required or appropriate and will disclose the new price before it becomes applicable to the relevant renewal, subject to applicable law.

15. Referral Programme

BetaStudy may introduce referral programmes under which users may receive discounts, credits, XP, promotional benefits, or other rewards.

BetaStudy may establish eligibility, redemption and anti-abuse requirements for each referral programme and may modify, suspend or discontinue a referral programme subject to applicable law.

16. XP, Points, Badges and Virtual Rewards

BetaStudy may provide XP, points, badges, streaks, rankings, leaderboard positions, achievements, and other virtual features.

BetaStudy currently does not offer monetary or physical prizes as part of its ordinary competitions. If prize-based competitions are introduced, separate rules may apply.

17. Educational Purpose & No Guarantee

BetaStudy is an educational and exam-preparation tool. BetaStudy does not guarantee:

• Exam success or a passing score;
• Certification award;
• Employment, promotion, or salary increases;
• Professional advancement; or any other particular outcome.

Your results depend on many factors outside BetaStudy's control.

18. AI-Generated Content

BetaStudy uses its own AI model. AI-generated questions, explanations, recommendations, study plans and other outputs are provided for educational and informational purposes.

19. Certification Information

BetaStudy makes reasonable efforts to keep certification information and preparation materials current. However, certification providers may change exam objectives, exam domains, exam formats, requirements, policies, certification names, pricing, and eligibility criteria. BetaStudy does not guarantee that all information will always reflect the latest certification-provider changes. Users should verify current examination requirements with the relevant certification provider before taking an examination.

21. BetaStudy Intellectual Property

BetaStudy and/or its applicable licensors own all rights in the BetaStudy platform, software and code, branding, trademarks, original questions, original explanations, study plans, algorithms, databases, learning systems, user interfaces, platform design, AI technology, and other proprietary materials.

Except where expressly permitted, you may not copy, reproduce, distribute, sell, publish, license, modify, reverse engineer or commercially exploit BetaStudy's proprietary materials.

22. Licence to Use BetaStudy

Subject to these Terms, BetaStudy grants you a limited, non-exclusive, non-transferable, revocable licence to use BetaStudy's proprietary educational content for your personal, non-commercial educational purposes. This licence does not transfer ownership of BetaStudy intellectual property to you. A separate enterprise or commercial licence may provide broader rights.

23–24. User Content & Content Licence

Users may submit study notes, questions, reviews, ratings, profile information, images, files, and other supported content. You remain responsible for content you submit and represent that you have the necessary rights and authority to submit it.

You retain ownership of your user-generated content. By submitting content to BetaStudy, you grant BetaStudy a broad, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt, modify, distribute and otherwise use that content as reasonably necessary to operate, maintain, improve, moderate, communicate about, and promote BetaStudy.

You must not submit content that violates third-party rights, infringes intellectual property, breaches confidentiality, contains malicious code, is fraudulent, abusive, defamatory, misleading, or unlawful.

26–27. Content Moderation & Genuine Reviews

BetaStudy may review, moderate, restrict or remove user content where reasonably necessary to enforce these Terms, comply with law, protect users, address security, or prevent abuse. BetaStudy may suspend or terminate accounts for serious or repeated violations.

Users may post reviews and ratings based on genuine experience. Reviews must be honest and not misleading. BetaStudy may remove fake, fraudulent, defamatory, or unlawful reviews, but will not remove genuine negative reviews merely because they are negative.

28. User Profile Visibility

A user's profile name and profile picture may be visible to other users where they participate in the same study activity, study group, competition, XP activity, or other applicable social learning feature. BetaStudy will not make profile information publicly visible beyond the functionality described without an appropriate lawful basis or permission where required.

30–31. Organisations, Enterprise Users & Data Governance

Where organisations purchase BetaStudy for employees or students, the organisation is responsible for ensuring user authorisation, providing appropriate notices, obtaining consents, and managing administrator access. Organisation administrators cannot access individual learning data or scores unless the user has consented or applicable law permits.

BetaStudy acts as an independent controller for personal data it processes to operate the Service. Where BetaStudy processes personal data solely on an organisation's documented instructions, BetaStudy acts as processor under an appropriate Data Processing Agreement (DPA).

32–34. Availability, Modifications & Discontinuation

BetaStudy does not guarantee uninterrupted, continuous or error-free availability. Access may be temporarily suspended for maintenance, upgrades, security, or emergency circumstances.

BetaStudy may add, modify, improve, suspend or remove features. Where a material reduction to a paid service occurs, reasonable notice will be provided where practicable.

If BetaStudy permanently discontinues the Service, users who have prepaid for an unexpired period will receive an appropriate pro-rata refund for the unused prepaid period, unless applicable law requires a different remedy.

35–37. Suspension, Termination & Account Deletion

BetaStudy may suspend or terminate accounts for Terms violations, fraud, abuse, security concerns, or legal requirements. Reasonable notice and opportunity to remedy will ordinarily be provided where practicable, except where immediate action is necessary for security, fraud, or legal compliance.

Users may delete their accounts through account settings or by emailing hello@betastudy.com.

Upon termination, access to paid features and licenses cease. Provisions relating to intellectual property, confidentiality, liability, dispute resolution, and payment obligations survive termination.

38–40. Third-Party Services, IP & Affiliates

BetaStudy may integrate with or link to third-party services. BetaStudy is not responsible for the availability, accuracy, security, or privacy practices of external third parties.

Where BetaStudy introduces referral partnerships, affiliate links, or sponsored content, such relationships will be appropriately disclosed where required by law.

41–43. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, BetaStudy is provided on an "as available" basis without warranties of any kind.

44–46. Consumer Rights, Indemnity & Force Majeure

Consumer Rights: Nothing in these Terms removes or restricts mandatory consumer rights. Where a provision conflicts with mandatory consumer protection laws in your jurisdiction, the mandatory law will prevail.

Indemnity: To the extent permitted by law, you agree to indemnify and hold BetaStudy and SPLEXX INNOVATION DYNAMICS LTD harmless from claims, losses, and reasonable expenses arising from your unlawful use, violation of these Terms, infringement of third-party rights, or fraudulent conduct.

Force Majeure: BetaStudy is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, government actions, major infrastructure outages, or widespread cyber incidents.

47–50. Governing Law, Dispute Resolution & Complaints

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. However, nothing in these Terms limits mandatory consumer or privacy rights that apply under the laws of your country of residence.

Users may submit complaints to hello@betastudy.com or to their competent regulatory or consumer-protection authority.

51–56. Electronic Communications, Severability & Entire Agreement

Electronic Communications: By using BetaStudy, you consent to receive electronic communications (emails, in-app notifications, security and payment notices), satisfying legal writing requirements. Formal legal notices may be sent to hello@betastudy.com.

No Waiver & Severability: Failure to enforce any provision is not a waiver. If any provision is held invalid or unenforceable, it will be modified or severed to the minimum extent necessary, and remaining provisions will remain in full force.

Entire Agreement: These Terms, together with the Privacy Policy, subscription terms, and any applicable DPA or enterprise agreement, constitute the entire agreement between you and BetaStudy.
